Informed consent is not simply a signed form, but a comprehensive process in which patients are given clear, understandable information about the nature of the treatment, expected outcomes, potential risks and side effects, contraindications, and available alternatives, including no treatment. For weight loss medications and procedures, this also includes discussing variability in results, the need for ongoing monitoring, and the possibility that progress may be slower or less significant than expected.

Unrealistic Expectations Due To Marketing Claims 

Marketing in the med spa industry can sometimes set unrealistic expectations by focusing on fast weight loss, dramatic before-and-after results, or “effortless” changes. These ads can make it seem like results happen quickly and without much effort, which is not usually the case. When expectations do not align with actual results, people can end up feeling disappointed, even if the treatment is working properly.

During this period, FDA shortage designations allowed compounding pharmacies under Sections 503A and 503B to prepare alternative versions when commercial supply was limited.

In contrast, non–FDA-approved or compounded versions are not reviewed by the FDA for the same standards, even if they contain similar active ingredients. These compounded products may be prescribed in specific situations but do not carry the same regulatory approval or guarantees of consistency, safety, or efficacy.

In February 2026, the FDA announced that it was actively addressing misleading direct-to-consumer advertising following warning letters issued in the fall of 2025. Companies are prohibited from suggesting that non–FDA-approved compounded products are equivalent to FDA-approved medications or that they function as generic versions. They also may not claim that compounded drugs contain identical active ingredients or are clinically proven to deliver the same outcomes. The FDA has stated that it will use all available enforcement authorities to address unsupported claims and protect public health. Manufacturers, distributors, and marketers of unapproved compounded GLP-1 products were cautioned that failure to correct violations may result in enforcement actions without further notice, including product seizure or an injunction.
