CBD and Med Spas: What’s Legal and What’s Not
The med spa industry is constantly evolving to meet the growing demand for innovative, non-invasive treatments that promote relaxation and overall well-being. One trend gaining traction is the incorporation of CBD (cannabidiol) into med spa services. CBD continues to grow in popularity in the United States and is now popping up in medspas. Known for its calming and anti-inflammatory properties, CBD has become a sought-after ingredient in wellness therapies and skincare, making it a natural fit for many medspas. From CBD-infused facials to pain-relieving massage oils, medspa clients are increasingly seeking out CBD services. There are some risks involved, however, that can lead to legal trouble for medspa owners. Here is what medspa owners should know if they are interested in offering CBD treatments.
CBD And Its Presence In MedSpas
CBD is a compound derived from the hemp plant, known for its anti-inflammatory, pain-relieving, and calming properties. Unlike THC, the psychoactive component of cannabis, CBD does not produce a “high,” making it a safer and more widely accepted ingredient in wellness products.
The 2018 Farm Bill reclassified cannabis with extremely low THC levels, excluding it from the Controlled Substances Act’s definition of “marijuana.” Both industrial hemp and marijuana come from the same cannabis species, but industrial hemp contains less than 0.3% THC, the psychoactive compound responsible for producing a “high.” The Farm Bill broadened the definition of hemp to include any cannabis plant with THC levels below 0.3%, not just stalky plants with small leaves. As a result, the sale of CBD derived from cannabis with less than 0.3% THC is no longer considered a violation of the Controlled Substances Act. As a result, CBD products–including those marketed for wellness–have experienced major sales in states across the country.
However, each state has its own laws on CBD. This can complicate compliance for med spas operating in multiple locations. In Georgia, for instance, it is now illegal to sell CBD products to anyone under age 21. Therefore, it is not enough to understand the federal regulations but to know any state laws regarding CBD in the states that the medspa operates in.
CBD Applications in MedSpas
CBD can be used in a variety of medspa treatments. CBD offers a range of physical benefits when applied topically. It can help reduce inflammation, alleviate discomfort, support healthy blood circulation, and promote improved skin health and appearance. CBD oil provides a relaxing and calming sensation without causing any intoxicating effects. Here are a few of the most common applications:
Facials and Skincare
CBD is a powerful antioxidant and anti-inflammatory agent, making it an excellent addition to skincare treatments. It can help to promote hydration and a glowing complexion, reduce redness and puffiness, and soothe irritated skin. CBD-infused facials are particularly popular among clients seeking natural remedies for acne, rosacea, or sensitive skin.
Massage Therapy
CBD oil is often used in massages to enhance relaxation and target muscle tension. Benefits include deeper muscle relief, enhanced stress reduction, and reduced joint and muscle inflammation.
Body Treatments
CBD-infused scrubs, wraps, or lotions are used in body treatments to nourish the skin and promote overall relaxation. These treatments can also target localized discomfort, such as back or shoulder pain.
Pain Management Therapies
For clients experiencing chronic pain or soreness, CBD can be incorporated into pain management therapies offered by med spas. Its natural analgesic properties provide relief without the need for pharmaceuticals.
Risks Of Offering CBD Services
As great as CBD-infused services can be for patients, there are some risks involved. The first involves purity. When CBD is “pure,” it does not contain THC. While research on the risks of CBD use is still underway, the FDA has identified potential adverse health effects associated with cannabis products containing THC, particularly for pregnant or lactating women. Although CBD topicals generally have minimal THC content, spas should be transparent with clients about possible risks. A study of 84 CBD products purchased online revealed that over a quarter contained less CBD than advertised, and 18 of the products were found to contain THC.
Additionally, even if CBD is truly pure, it can cause side effects in some individuals. While most people generally have no problems with it, CBD can cause side effects like dry mouth, diarrhea, reduced appetite, drowsiness, and fatigue. Additionally, CBD may interact with medications, including blood thinners.
Another risk with CBD is that users might have ideas about the benefits of CBD products and services that are incorrect. Medspas should also ensure that the products and services they offer are free from false or misleading claims. The U.S. Food and Drug Administration (FDA) has sent warning letters to several CBD companies for promoting their products with unverified health benefit claims in marketing materials, packaging, or websites.
Mitigating Risks in CBD-Infused Services
To ensure the safe and effective use of CBD-infused services, medspas should take precautionary measures. Implementing these strategies can build trust, enhance client satisfaction, and reduce liability:
Ensure Product Purity
Source CBD oil exclusively from reputable suppliers who provide third-party lab testing. Verify THC content to ensure compliance with legal standards and transparency with clients.
Educate Clients on Potential Side Effects
Inform clients about possible adverse effects, such as dry mouth, fatigue, or diarrhea. Discuss the potential for interactions with medications like blood thinners.
Maintain Transparency About Benefits
Avoid making unverified claims about CBD’s effectiveness in advertising or consultations. Provide clients with evidence-based information about the realistic benefits of CBD-infused services.
Comply with Regulatory Standards
Regularly review FDA guidelines and ensure all products meet legal and safety requirements. Train staff to communicate risks and benefits clearly to clients.
Contact an Experienced Medspa Attorney
CBD offers exciting opportunities for med spas to enhance their services and attract new clients. However, navigating the legal landscape requires careful planning and due diligence. Partnering with an experienced healthcare lawyer who understands medspas can help you provide cutting-edge treatments, such as CBD treatments, while avoiding any legal pitfalls.
